TERMS AND CONDITIONS OF USE FOR SPURBETS PLATFORM
By accessing, browsing or using the Spurbets platform (the "Platform"), you agree to be bound by these Terms and Conditions (these "Terms"). If you do not agree with any of these Terms, please do not access, browse or use the Platform.
In these Terms, the following words and phrases shall have the meanings set out below:
You must be at least 18 years old to use the Platform and place bets. By using the Platform, you warrant that you are at least 18 years old.
Spurbets may suspend or terminate your access to the Platform if Spurbets reasonably believes that you have breached these Terms.
We will collect and process personal data in accordance with our Privacy Policy, which is available on the Platform. You agree that we may use your personal data for the purposes of providing the services offered by the Platform.
You must ensure that all information provided to us (including but not limited to passwords and login credentials) remains confidential and secure. You are responsible for all activity that occurs under your account, including any bets placed or withdrawals made.
We may ask you from time to time to confirm whether you wish to continue using the Platform in light of any concerns we may have about your betting habits or any other matters.
We may modify these Terms at any time without prior notice. You agree that it is your responsibility to regularly check for and review the current version of these Terms. Your continued use of the Platform after any modification shall be deemed acceptance of such modified terms.
These Terms shall be governed by and construed in accordance with the laws of Kenya, without giving effect to any principles of conflicts of law. Any disputes arising from or related to these Terms shall be resolved through binding arbitration in accordance with the rules of the Arbitration Act 1995.
Any dispute arising out of or in connection with these Terms or use of the Platform, including but not limited to a claim that the Platform is in breach of contract or has been negligent, shall be governed by and construed in accordance with the laws of Kenya and shall be resolved through binding arbitration in accordance with the rules of the Arbitration Act 1995.
Spurbets does not warrant that the Platform will operate error-free or uninterrupted, but we will use our best efforts to ensure that it is available to you at all times. We disclaim all liability for any losses or damages (whether direct, indirect, special, incidental or consequential) arising out of your use of the Platform.
To the fullest extent permitted by law, Spurbets disclaims all warranties and conditions of any kind, whether express, implied, statutory or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement.
We shall not be liable for failure to perform any obligation under these Terms if such failure is caused by the occurrence of any unforeseen event beyond our reasonable control, including but not limited to war, industrial disputes, fire, flood, riot, civil commotion or other calamity.
We may modify or change any part of the Platform at any time without prior notice and you agree that such modifications shall be effective immediately.
You can cancel your account by notifying us in writing (including but not limited to by email). Once we receive your request, your account will be cancelled and you will no longer have access to the Platform or be able to place bets.
These Terms constitute the entire agreement between Spurbets and you with respect to your use of the Platform and supersede all prior agreements or understandings, whether written or oral.
Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the Arbitration Act 1995.
You agree that you will not bring any claim against Spurbets, its officers or employees for any loss, damage, cost, charge or expense which arises out of your use of the Platform or these Terms.
If any provision of these Terms is held to be invalid, illegal or unenforceable in whole or in part by a court of competent jurisdiction, then such provision will be deemed to have been severed from these Terms and shall not affect the validity and enforceability of the remaining provisions.
These Terms constitute the entire agreement between Spurbets and you with respect to your use of the Platform and supersede all prior agreements or understandings, whether written or oral.
